A rent agreement is the single most useful document in any tenancy. It protects the tenant's deposit and the owner's property. Here is how they work in Lucknow, and what to put in yours.
Why so many agreements are for 11 months
Across India, leases of a year or more generally have to be registered at the sub-registrar's office, which adds cost and a visit. That is why most residential agreements are made for 11 months and renewed. In Uttar Pradesh, reports say agreements longer than 11 months must be registered. A shorter agreement is still a valid written contract.
Stamp duty and e-stamping
- Rent agreements in Uttar Pradesh are made on e-stamp paper, bought online or through authorised vendors.
- The stamp duty depends on the rent, the deposit and the length of the agreement. Published guides quote different rates, so check the current rate on the state's stamp and registration portal (IGRSUP) or with a sub-registrar before you buy the stamp.
- If you register the agreement, a registration fee is also payable.
Informing the Rent Authority
Under UP's 2021 tenancy law, the owner and tenant are expected to inform the district Rent Authority about the tenancy. Keep the acknowledgement with your agreement.
The clauses that matter most
- Names, address of the flat and the term (start and end dates).
- Monthly rent, due date and how it is paid. Bank transfer leaves a record.
- Security deposit and when it is returned. For homes, UP law caps it at two months' rent.
- Yearly rent increase, written as a percentage.
- Maintenance, water, electricity and parking: who pays what.
- Notice period for either side to end the agreement early.
- Lock-in period, if any.
- Repairs: which small repairs the tenant handles, and which the owner fixes.
- List of fittings and furniture, with their condition.
- Use of the flat: residential only, number of occupants, pets if relevant.
Attach photos of the flat at move-in, and sign every page.
Common mistakes
- Moving in before the agreement is signed.
- Paying the deposit in cash without a receipt.
- An agreement that says nothing about the yearly increase, followed by a big jump at renewal.
We prepare the agreement for every home we let, so owner and tenant start on the same page. See our properties for rent or list your property.
